Camperbug Self Hire Agreement - Terms & Conditions 

Definitions: You, the registered owner/keeper as described overleaf and whose address details are listed on this website ("The Owner") agrees to the conditions set out below.  
Camperbug.co.uk ("The Agent") whose registered office is 2b Swanfield Street, London E2 7DS agrees to the conditions set out below. The Campervan vehicle that is listed on the Camperbug website whose details and registration mark are listed on the Camperbug website ("The Campervan") 

The Hirer whose name and address can be viewed on  the Camperbug hire page relating to this hire, whose contact details you will receive once these terms are accepted ("The Hirer") who resides at the address listed on the Camperbug Hire page relating to this hire and has hired the Campervan for the period of the Agreement and has agreed to the Camperbug Hirer Terms and Conditions.

The dates showing the period of hire ("The Period") This is the period for which the Hirer has rented the campervan as laid out on the hire page relating to the rental.

1. Period of Agreement: 
a) This document records all the terms agreed between the Owner and the Agent in respect of the Campervan at the dates set out for the Period.
b) This document shall be legally binding on the acceptance hereof, which is denotated by the checking of the tickbox at the foot of this agreement.
c) The Owner and the Agent agree this agreement will run continually from the date of acceptance until the final time and date of the Period.
d) This agreement once accepted cannot be terminated by the Owner.  

2. The Owner: 
a) Instructs the Agent that the Campervan is available for rental exclusivley through the Agent for the Period as set out above
b) The Owner agrees to make the Campervan available for the Period to the Hirer.
c) The Owner agrees that an extensive discourse has been entered into with Camperbug in relation to this hire and confirms before release of Hirer’s details that they are satisfied of the details supplied to Camperbug of the hirer’s ability to enter into an insurance contract with the owner in relation to this self drive hire.
d) The Owner agrees that they are satisfied that discussions with Camperbug which are confirmed on messages sent via the the Camperbug website messaging system have ascertained the suitability of the Hirer for the rental of their vehicle.
e) By Accepting this contract the Owner agrees to the Agent that they are happy that the Agenct has informed them of the suitability of the hirer in a message sent through the Camperbug messaging system, by telephone or email before the contract commences.
f) Agrees to the Agent that no other booking queries will be taken for the Period.
g) Shall remain liable to the Agent for the hire booking fee and to the hirer for the cost of any alternative vehicle or compensation claimed by the hirer, if, as a result of the Owner failing to comply with all or any of the terms of this Agreement, the Campervan
is unavailable to a hirer for a hire booking as agreed between the Agent and the Owner, that is taken by the Agent.    

3. The Owner: 
a) Warrants that the Campervan entry listed on the Camperbug website which can be updated by them at any point in respect of the Campervan is correct.
b) Warrants to make the Agent aware of any entries that are not correct for the Campervan.
c) Undertakes to maintain the availability of the advertised accessories/facilities at the Campervan and to give the Agent immediate written notice of any change or withdrawal of accessories/facilities.  

4. The Owner undertakes:
a) To ensure the Campervan is clean, roadworthy, taxed, tested & MOT and in all respects presentable and maintained for the arrival of each new hirer. 
b) To ensure the Campervan is for the Period completely safe for driving for the Hirer and specifically, that all tyres are correctly pressurized and the minimum level of tread to fully comply to road safety standards, that all accessories and equipment in/on the Campervan are in good and safe working order and any water and gas containers are maintained to sufficient safety standards to comply with the manufacturers recommendations. 
c) Promptly take all reasonable steps, so far as the Owner is so able to resolve or alleviate to the hirer's reasonable satisfaction, any problems or complaints during a hire. 
d) Provide adequate breakdown cover for every period of hire. 
e) Immediately upon being so requested by the Agent, to take all reasonable steps to bring the Campervan or any part of the interior or exterior thereof to such standard of safety and roadworthy specification and quality as may be required to comply with the terms of this Agreement.   

5. The Owner: 
a) Agrees that the Agent shall not be liable for any loss, damage or injury howsoever caused to the Campervan or to any hirer or other person occupying the Campervan or to any personal property belonging to the same.
b) Hereby covenants to indemnify and keep indemnified the Agent from and against all action claims and demands including legal fees and costs incurred by the Agent in respect of any non-observance or non-performance of the terms of this agreement by the Owner or arising from any act or omission, negligent or otherwise, by the Owner occurring or relating to the provision of vehicle hire in the Campervan.   

6. The Agent:  
a) Agrees to include the Campervan and details of its availability and specification, on the Camperbug web site and make it available for hire to all website visitors. 
b) Agrees to advertise the Campervan as appropriate
 
7. The Agent on receipt of a booking enquiry:  
a) will have discussed said enquiry with the Owner via email, or telephone or on the Camperbug booking enquiry system.
b) Provided the Campervan is available for the period requested by the hirer and upon the agreement of hire of the Campervan for the Period by the Owner, the Agent upon receipt of payment of a booking deposit from hirer can confirm that hire booking to the Hirer in writing, thereby on behalf of the Owner, legally committing the Owner to provide the vehicle hire comprised in the Campervan to the hirer in accordance with the terms of this agreement.   

8. The Owner and Agent further agree:  
a. That immediately upon the email confirming a hire booking being sent by the Agent on behalf of the Owner to a hirer, a legally enforceable agreement as between the Owner and the hirer exists on the part of the Owner to provide vehicle hire comprised in the Campervan to the hirer in accordance with the terms of this agreement and on the part of the hirer to pay for the hire so booked. It is specifically understood and agreed that the Agent acts only as the Owners Agent in arranging such agreement for the provision of vehicle hire.
b. That if the Owner is in breach of any/all the terms of this agreement the Agent in its discretion shall be entitled to rescind this agreement and consequently cease advertising and taking bookings for the Campervan and cancel any hire bookings yet to be taken.
c. Gas appliances are subject to The Gas Safety (Installation and Use) Regulations 1998. The owner must ensure that all gas appliances, fittings and flues provided for hirers' use are safe. Gas appliances should be serviced annually by a GasSafe-registered installer. This service must incorporate an annual safety check of each gas appliance/flue. Before any new hire starts, the owner must make sure that these checks have been carried out within one year before the start of the hire date, unless the appliances in the Campervan have been installed for less than 12 months, in which case they should be checked within 12 months of their installation date. The safety check record will contain details of any defect identified and remedial action taken. The owner must ensure that any safety defect is rectified by a CORGI-registered gas installer before the equipment is used again. It is a legal requirement to display a current Gas Safety Certificate for each gas appliance in close proximity to each appliance. It is an offence to use, or allow the use of, a gas appliance known to be unsafe. In no circumstances should an appliance be reconnected that has been deemed unsafe, which has either been isolated or
disconnected for safety reasons, until the fault is rectified. As a provider of LPG gas to the Hirer, agree what action to take in case of a gas escape or emission of carbon monoxide from any LPG appliance. 

9. Termination 
a) This agreement may be terminated in writing by either party to the other PROVIDED that such termination shall not be effective until the Campervan with its advertised accessories/facilities has been made available by the Owner to fulfill all outstanding bookings confirmed by the Agent.
 
10. The Owner and Agent agree:   
a) This agreement is governed by English Law.
b) This agreement may not be assigned by the Owner without the prior written permission of the Agent. The Agent may assign this agreement and the Owner agrees that the Agent may authorise another company to carry out the Agents acts relating to this Agreement on the Agents behalf and in the Agents name.
